CARRIER OBLIGATIONS
1. Information regarding the weight, measure, quantity, condition,
contents and value of the consignment is provided to Patricks by the shipper,
through its principal carrier. The actual weight, measure, quantity,
condition, contents and value of the consignment is unknown to Patricks and its
principal. Patricks accepts no liability for losses arising from any inaccuracy
of the information. It is the carrier's obligation to obtain a complying
weight declaration from the consignor or the person who arranged for the
transport of the container and/or goods (to the extent that there are such
persons). Patrick are not, and will not be deemed to be a consignor as defined in
Road Transport Reform Law and accepts no liability as such. The Customer
authorises
Patrick to name the Customer or another person as the consignor in any
documentation where applicable.
2. The carrier must comply with all applicable laws (including the
Road Transport Reform (Compliance and Enforcement) legislation) relating to
the carriage of containers and/or goods. The carrier represents and
warrants that the vehicle allocated to collect the container and/or goods
will be capable of carrying such loads without contravening those laws. Patricks
reserves the right not to load vehicles which, in its opinion, could breach
applicable mass, dimension or load restraint limits or requirements.
3. Please be reminded that Patrick Terminals will not accept liability
for damage due to; faulty or incorrectly positioned twistlocks,
Sideloaders, Rear legs or Tail gates.
4. The carrier represents and warrants that it will comply with all
applicable laws (including the Australian Dangerous Goods Code) relating to
the nature, condition, packaging, handling, labelling, storage and carriage
of Dangerous Goods on a public road. "Dangerous Goods" means dangerous
goods as defined in the Australian Dangerous Goods Code, and any goods which
are dangerous, volatile, explosive, inflammable or offensive, or which may
become dangerous, volatile, explosive, inflammable or offensive, or which
may become harmful to any person, property or the environment whatsoever.
Access to and use of the Patrick Online Vehicle Booking System Website (“VBS”) is governed by the Conditions of Access below:
1.CONDITIONS OF ACCESS
In consideration of Patrick granting the Carrier access to Patrick’s VBS, the Carrier agrees to:
(a) Pay the rates as set out below; and
(b) Comply with any requirements set out in the Patrick Vehicle
Booking System Handbook; and
(c) Comply with the security measures required by any applicable laws and regulation, and with Terminal Safe Operating Procedures; and
(d) When at a Patrick terminal, comply with Patrick’s Conditions of
Entry at all times.
2. RATES
The Carrier agrees to pay Patrick the rates listed below:

A Booking Fee is payable for each slot booked.
A No Show Fee applies where a booking is not utilised at the terminal, including but not limited to where the scheduled container truck does not arrive within the standard zone time set by each terminal and/or the scheduled container transaction is unable to be completed due to incorrect or incomplete carrier/cargo owner processes. ( e.g. incomplete documentation, statutory authority impediments)
Above rates are subject to periodic review, usually with effect 1 July each year.
3. INVOICING
On the first day of each month Patrick will provide the Carrier with an invoice specifying the aggregate value of Rates payable for the preceding month.
4. PAYMENT
The carrier agrees to pay the invoice within 7 days. If the Carrier disputes an invoice it must notify the relevant Patrick terminal contact within 7 days from the date of the invoice. The Carrier and Patrick will act in good faith in an attempt to resolve the dispute within 28 days. Any such adjustment that may be required will be made by Patrick following the appropriate resolution of the dispute.
5. LIMITATION OF LIABILITY
Patrick shall not be liable for any claim, demand, liability, or consequential losses under any circumstances, howsoever arising or howsoever caused. The Carrier shall indemnify Patrick for any claim arising out of or in any way connected with the Carrier’s use of or access to Patrick’s VBS Website.
The liability of Patrick in respect of an incident is limited to supplying the services again or to the payment of the cost of having the services supplied again.
6. WHEN PATRICK MAY TERMINATE
Patrick reserves the absolute right to suspend or terminate the Carrier’s registration and disable the Carrier’s access to Patrick’s VBS immediately if the Carrier breaches these Conditions of Access. In the event that the Carrier’s registration is suspended or terminated, the Carrier will be advised by e-mail. Patrick accepts no liability for any loss or damage that may arise due to suspension or termination of the Carrier’s registration.
